Training and Procedure Requirements
Site personnel must meet the following training and procedural requirements for informed consent and human sterilization:
ALL of the following
- Patients must be informed about any proposed treatment or procedure that includes medically significant risks, alternate courses of treatment or non-treatment and the risks involved in each, and the name of the person who will carry out the procedure or treatment.
- Documentation of the informed consent discussion and the signed consent must be written and included in the member's medical record.
- The consent process must be conducted by a physician or physician designee.
- Provide the DHCS-published booklet and a copy of the consent form to the member; utilize Consent Form PM 330 (Consent to Sterilization).
- Provide answers to any questions the member may have and inform the member they may withdraw or withhold consent at any time before the sterilization procedure.
- Describe fully the available alternatives for family planning and birth control and advise that the sterilization procedure is considered irreversible.
- Explain fully the discomforts, risks, and benefits of the procedure.

Staff must provide and document an informed consent discussion for human sterilization and include the signed consent in the member's medical record. Use Consent Form PM 330 (Consent to Sterilization) and provide the DHCS booklet and a copy of the consent form to the member; the discussion must be conducted by a physician or physician designee and include answers to member questions, alternatives, risks/benefits, that the procedure is considered irreversible, and the member's right to withdraw consent at any time before sterilization.

- Utilize the PM 330 sterilization consent form (Consent to Sterilization) and provide the DHCS booklet and copy of the consent form to the member.
- Consent discussion must be conducted by a physician or physician designee and include explanation of risks, benefits, alternatives, who will perform the procedure, right to withdraw consent, and answers to any questions.
