Notifies New Mexico Tribes, Tribal health providers, and interested parties of proposed amendments to NMAC 8.200.410 (Medicaid Eligibility - General Recipient Rules) and requests written tribal advice and comments by June 5, 2026. Affects tribal stakeholders and Medicaid eligibility for certain noncitizen categories in New Mexico.
Section 11 has been updated to remove non-citizens no longer eligible for Medicaid.
Section 8 has been updated to include HCA's current mission statement.
Throughout the NMAC, updates replace references from HSD to HCA and revise formatting/language.
Proposed Eligibility Changes
COVERAGE CRITERIA
Proposed NMAC amendments update eligibility to remove certain noncitizen categories from Medicaid eligibility. Coverage is limited effective October 1, 2026 to the categories listed below; specified lawfully residing noncitizen groups will no longer be eligible.

- A citizen or national of the United States
- Legal Permanent Residents
- Cuban/Haitian entrants
- Compact of Free Association (COFA) migrants
- Lawfully residing children and pregnant individuals under CHIPRA 214
ALL of the following
INCLUDES
- Refugees
- Asylees
- Parolees
- Certain abused spouses and children
- Individuals with temporary visas
- Individuals with Temporary Protected Status (TPS)
- Certain victims of trafficking
- Other lawfully residing noncitizen groups described in Section 71109

- Section 8 updated to include HCA's current mission statement.
