Coverage Criteria — Short Inpatient Hospital Stay

Covered when ANY of the following are met

An inpatient level of care for hospital stays of less than three midnights is medically necessary when meeting ONE of the following indications:

Indication A: Admission is for a procedure on the CMS 2024 Inpatient Only List for members age 18 and over, or listed as a pediatric inpatient-only procedure in InterQual for members under 18.

See CMS 2024 Inpatient Only List link in policy.

Indication B: Admission to an intermediate or intensive care unit level of care (including neonatal intensive care unit [NICU]) considered medically necessary per a nationally‑recognized clinical decision support tool, with the exception of diabetic ketoacidosis and drug overdose.
Indication C: Unexpected death during the admission.
Indication D: Departure against medical advice from a medically necessary (per a nationally‑recognized clinical decision support tool) inpatient stay.
Indication E: Transferred from another inpatient facility, with a medically necessary (per a nationally‑recognized clinical decision support tool) total length of stay of three midnights or more.three midnights or more

Transfer must be from an inpatient stay.

Indication F: Election of hospice care in lieu of continued treatment in hospital.
Indication G: If the hospital stay is expected to require an inpatient level of care or to exceed an observation timeframe; use the TMF Health Quality Institute decision tree supported by CMS to determine observation versus inpatient admission.

    Decision tree referenced in policy.

This policy specifically excludes behavioral health and obstetrical delivery admissions from the scope of the short inpatient stay guidance. Services for these admission types are not addressed by this policy and should be evaluated under the applicable behavioral health or obstetrical coverage rules.

Coverage determinations and the administration of benefits are governed by the member's coverage documents and applicable law. This clinical policy is a guide to medical necessity and does not constitute a contract or guarantee of payment; providers must follow all terms, conditions, exclusions and limitations of the member's evidence of coverage, certificate of coverage, policy, or contract of insurance when submitting claims and seeking prior authorization.

Observation services are intended as short-term assessment, treatment and reassessment to determine whether a patient requires inpatient admission or may be safely discharged. Observation care is typically completed within 24–48 hours and is not reasonable and necessary when it spans more than 2 days except in rare and exceptional cases; such longer observation should be justified by clinical documentation and applicable decision tools.

Provider Actions, Documentation & Prior Authorization

    Prior Authorization

Inpatient-only procedure requirement (CMS 2024; InterQual for pediatrics)

Admission for a procedure listed on the CMS Inpatient Only List (2024) is considered medically necessary for members age 18 and over; for members under 18, pediatric inpatient-only procedures listed in InterQual qualify. See the CMS 2024 Inpatient Only List link in the policy for the adult list and InterQual for pediatric listings.

    • Adults: follow CMS Inpatient Only List (2024) referenced in policy.
    • Pediatrics (<18): follow InterQual pediatric inpatient-only procedure listings.
    Prior Authorization

Verify prior authorization and plan-specific requirements

This clinical policy provides guidance to medical necessity determinations used to assist coverage decisions and administering benefits; providers must verify prior authorization requirements according to the member's contract and plan-specific administrative policies.

    • Clinical policy guides medical necessity but does not guarantee payment; check member-specific prior authorization rules.

    Background and Rationale

Observation services provide short-term monitoring, treatment and reassessment for patients who require additional time after initial presentation to determine whether inpatient admission is needed or discharge is appropriate. The decision between observation and inpatient admission should be based on clinical factors — including history, comorbidities, severity of signs/symptoms, current medical needs and risk of adverse events — and may be supported by the decision tree referenced in the policy.

    Definitions

Observation services — definition (observation care)
DefinitionObservation care: ongoing short-term treatment, assessment, and reassessment to decide whether patients will require further treatment as hospital inpatients or can be discharged
Typical timingDecision whether to admit or discharge can usually be made in less than 24–48 hours
PurposeUsed for patients presenting from the ED who require a period of treatment or monitoring to determine need for inpatient admission
Short inpatient hospital stay — inpatient level of care for stays under three midnights
DefinitionInpatient level of care for hospital stays under three midnights
When coveredMedically necessary when one of the policy indications is met (see policy I.A–I.G)

    Hospital Inpatient Admission Criteria

    hospital inpatient

Admission criteria: Meets one of the policy indications (see 'Covered when ANY of the following are met') including: inpatient-only procedure per CMS/InterQual; admission to intermediate or intensive care (including NICU) per a nationally‑recognized decision tool; transfer from inpatient with total stay ≥ three midnights; election of hospice; unexpected death; departure AMA; or expected need for inpatient care/exceed observation timeframe.

See coverage criteria and decision tree guidance in policy.

Continued Stay Criteria (Observation vs Inpatient)

    observation/inpatient

Observation vs continued inpatient: Continued stay determination should be based on clinical progress, ongoing need for short‑term treatment or monitoring, and likelihood of adverse events; observation services are commonly resolved within 24–48 hours and rarely exceed 2 days except in rare and exceptional cases.

Use clinical documentation and decision tree to support status decisions.

    Discharge Criteria

Discharge from observation or inpatient care should occur when the patient is clinically stabilized and the reason for observation has resolved such that safe discharge is appropriate per the treating physician and decision-tree guidance. Continued observation or inpatient stay must be based on documented clinical progress, ongoing need for short-term treatment or monitoring, and the likelihood of adverse events; observation ordinarily concludes within 24–48 hours and rarely exceeds 2 days except in exceptional circumstances.

    Day Limits for Observation

observation — usually <48 hours; rarely more than 2 days except in rare/exceptional cases
Typical durationObservation services usually resolve within 24–48 hours
Rare exceptionsOnly in rare and exceptional cases do reasonable and necessary outpatient observation services span more than 2 days
Implication for continued stayObservation that spans more than 2 days is generally not reasonable and necessary except in rare/exceptional circumstances

  1. Verify plan and contract-level administrative requirements before scheduling or admitting.
  2. Note

Use referenced decision tools for observation vs inpatient determinations

Providers should use the TMF decision tree and nationally‑recognized clinical decision support tools referenced in the policy when determining observation versus inpatient status to support medical necessity determinations.

    • Apply the TMF/TMF Health Quality Institute decision tree cited in the policy when the stay may exceed an observation timeframe.
    • Use nationally‑recognized tools to document ICU/IMC admission necessity and other decision points.
    Prior Authorization

Confirm and document applicable policy indication prior to admission

Before admission, confirm whether the member's condition meets one of the policy indications (e.g., inpatient-only procedure, ICU/IMC admission per a decision support tool, transfer with ≥ three midnights, hospice election) so that medical necessity rationale is documented and prior authorization requirements can be met.

    • Document which specific policy indication applies to the admission.
    • Confirm transfer cases meet the 'three midnights or more' threshold when applicable.
    Documentation Required

Document clinical justification for inpatient status

Document the clinical indications that support inpatient level of care, including relevant history/comorbidities, severity of signs/symptoms, response to treatment, diagnostic test results, and any operational notes that justify admission type.

    • Include patient history and comorbidities affecting need for inpatient care.
    • Record severity, current medical needs, response to treatment, and diagnostic findings.
    • Reference use of the decision tree or clinical decision support tool in the medical record when applied.
    Billing Rule

Follow Health Plan administrative policies and submit claims accordingly

Follow the Health Plan's administrative policies and procedures when submitting claims; this clinical policy is a guide to medical necessity but does not guarantee payment.

    • Submit claims per Health Plan billing and administrative rules.
    • Adhere to state/federal requirements and plan-level administrative policies.
    Denial Risk

Coding inclusion/exclusion does not ensure coverage — verify coding guidance

Inclusion or exclusion of codes in this clinical policy does not guarantee coverage; providers must reference the most up-to-date professional coding guidance before claim submission.

    • Policy code references are informational only; verify current CPT/HCPCS guidance prior to billing.
    Denial Risk

Coverage subject to member coverage documents; noncompliance may lead to denial

Coverage and benefit administration are subject to all terms, conditions, exclusions and limitations of the member's coverage documents; failure to follow those documents and applicable administrative policies may result in claim denial or noncoverage.

    • Check the member's evidence of coverage, certificate of coverage, policy or contract for applicable limitations.
    • Noncompliance with coverage documents or administrative requirements can trigger denial.
