Insurer Obligations and Compliance Steps
Provide and verify actuarially‑justified liability premium discount
Insurers must provide an actuarially‑justified discount on the liability premium for each commercial motor vehicle equipped with a dashboard camera and telematics system that meet the Regulation 138 requirements; insurers may verify ongoing compliance annually using a telematics summary report or a vendor certificate/signed affidavit, and failure to demonstrate compliance may result in forfeiture of the discount at renewal.
- Discount applies to liability premium only unless the insurer elects to extend it to other coverages (e.g., collision or comprehensive).
- Policyholders must provide proof of installation/operation via vendor certificate or telematics data report upon insurer request; insurers may accept a telematics summary report or a signed affidavit for annual verification.
- Equipment must be installed and operational at policy issuance or renewal, meet technical standards (including compatibility), and be in continuous use during the policy term; use and compatibility are subject to verification.
Mandatory premium discount obligation and actuarial justification
Every admitted insurer authorized to issue commercial motor vehicle insurance in Louisiana (except surplus lines insurers) is required to provide a discount on the liability premium for each commercial vehicle equipped with dashboard cameras paired with telematics systems; the discount amount must be actuarially justified based on loss experience, claims data, and other relevant factors.
- Insurer must determine discount amount using actuarial justification grounded in its own loss experience and claims data.
- Discount obligation arises under Regulation 138 and implements Act 19 (2025).
Penalties for willful noncompliance (R.S. 22:1969)
Any insurer found to be in willful noncompliance with Regulation 138 or R.S. 22:1482.2 is subject to the penalties specified in R.S. 22:1969.
- Willful noncompliance may trigger enforcement actions and penalties under state law per R.S. 22:1969.
- Failure to maintain required qualification/documentation may also lead to forfeiture of discounts at renewal until compliance is demonstrated.
