    Telemedicine/Telehealth Coverage Requirements

    Telemedicine/telehealth OP-SUD coverage requirements

Telemedicine/telehealth delivery is permitted for OP-SUD services during the COVID-19 declared emergency when all applicable requirements are satisfied.

    ALL of the following

    • The service is delivered during the COVID-19 declared emergency and is an eligible Medicaid-reimbursable OP-SUD treatment service, substance use disorder screening, assessment, or re-evaluation.
    • The service is medically necessary as determined by a physician or fully licensed mental health professional.
    • The provider and staff meet the qualifications and requirements in the Medicaid Behavioral Health Services Provider Manual, including applicable licensure, accreditation, and professional licensing-board requirements.
    • The provider obtains and documents informed consent for telemedicine/telehealth, including the rationale, risks and benefits, alternatives and their risks and benefits, and the risks and benefits of no treatment.
    • ONE of

      • The recipient is older than 18.
      • ALL of the following

        • The recipient provides consent before service initiation.
        • The recipient's parent or legal guardian provides consent before service initiation, and the parent's or guardian's contact information is documented.
    • An approved communication method is used

      • A secure, HIPAA-compliant platform is used when available.
      • If a secure HIPAA-compliant platform is unavailable, videoconferencing with reasonable security and privacy measures is used with the recipient's consent.
      • ALL of the following

        • Audio-only delivery is used only when an audio/video system is unavailable or not feasible.

At least an audio connection is required.

        • The recipient consents to the audio-only delivery.
    • Texting, email, and public-facing applications such as Facebook Live, Twitch, and TikTok are not used for the service.
    • The provider maintains the required clinical record, including the telemedicine/telehealth modality and, for audio-only delivery, the rationale for using audio-only communication.
    • The provider documents required clinical, safety, consent, participant, identity-verification, technical back-up, service-time, intervention, location, referral, and refusal information in the progress note.
    • If prior authorization applies

      • An existing prior authorization remains eligible for telemedicine/telehealth delivery without an addendum solely because the service is delivered through telemedicine/telehealth.
      • When an existing authorization expires during the emergency, the recipient's MCO may extend it for the same duration as the previously authorized units; new requests follow the MCO's standard process.
    • The claim includes modifier 95 and place of service 02 when the service is delivered through telemedicine/telehealth.

    Telemedicine/telehealth group therapy requirements

Telemedicine/telehealth group therapy is permitted only when all general OP-SUD requirements and the following additional safeguards are met.

    ALL of the following

    • The group service relates to the recipient's goals, objectives, and interventions in the treatment plan.
    • The recipient attempts to participate from a private room or other private setting to reduce the risk of being overheard by persons near the recipient.
    • The recipient agrees not to disclose information outside the group that could identify another group member.
    • The recipient agrees to waive confidentiality before the session begins.
    • The recipient acknowledges and signs a confidentiality agreement requiring protection of the privacy of other persons receiving treatment.

    Provider Documentation and Operational Actions

    Prior Authorization

    Prior Authorization Continuity

An existing prior authorization does not require an addendum when services are delivered by telemedicine/telehealth, and reimbursement requirements otherwise remain unchanged. During the COVID-19 declared emergency, an MCO may extend an existing OP-SUD authorization that expires during the emergency for the same duration as the previously authorized units; new requests must follow the recipient’s MCO standard process.

    • Document continuation and service needs when requested by the MCO, including needs for continued service continuity or expanded service coordination.
    • The extension applies only when the recipient’s MCO requires a prior authorization and remains available through the end of the COVID-19 declared emergency.
    Documentation Required

    Consent and Signature Documentation

Obtain informed consent before delivering telemedicine/telehealth. Discuss the rationale for telehealth, its privacy-related risks and benefits, alternatives and their risks and benefits, and the risks and benefits of no treatment; document required recipient, guardian, participation, agreement, and signature information.
