Nurse aide certification and registry criteria
Certification, recertification, and registry rules for nurse aides — covered when ALL of the following groups of conditions are met as specified below.

- Complete a nurse aide training program approved by the director of the department of human services (no person may take the exam until training successfully completed).
- Pass the director-approved nurse aide examination (written or oral, applicant's election) with a minimum score of 70%.
- Successfully demonstrate skills: pass a skills evaluation consisting of five randomly selected items drawn from a pool of tasks generally performed by a nurse aide (must demonstrate all five).
ALL of the following
- Reciprocity may be granted to a qualified nurse aide from another state with comparable requirements.
- Upon meeting all requirements, the director shall provide a certificate to the nurse aide.
ALL of the following
- An annual performance review completed by the facility at least once every 12 months.
- Regular in-service training provided by the facility based on the outcome of the annual performance reviews.
- A completed renewal application on a department-approved form, signed by an authorized facility official (director of nurses, RN, director of human services, physician or designee) verifying completion of the review and in-service training; form must be postmarked or received by the department on or prior to 30 days before the biennial expiration date.
- Verification that the nurse aide provided, for monetary compensation, at least one full day of nursing or nursing-related direct patient care in a Medicare/Medicaid certified nursing facility within the prior 24 months.>= 1 full day within prior 24 months

- Completion of a competency evaluation approved by the department of human services.
- A completed renewal application including applicable fees on a department-approved form, postmarked or received on or prior to 30 days before the biennial expiration date.
- Verification acceptable to the department that the nurse aide provided, for monetary compensation, at least one full day of nursing-related services involving direct patient care in a state-licensed or state-certified setting within the prior 24 months.>= 1 full day within prior 24 months

- If the nurse aide has not provided proof of at least one full day of compensated direct patient care within the prior 24 months, or fails to meet renewal requirements, the nurse aide must complete the initial certification requirements of §16-89A-3 anew.

- The department shall establish and maintain a registry of all certified nurse aides (including those certified by reciprocity); record of successful certification must be included within 30 days.record included within 30 days
- Registry shall contain: full name; home address; home and work telephone numbers; social security number or other identifier and verification of being at least 18 years of age; place of employment; date eligible for entry in the registry (date of successful certification or date deemed to meet requirements).
- Any substantiated finding of abuse, neglect, or misappropriation reported by the department of health or department of human services must be documented and reported to the registry within ten working days and included in the registry; registry information specified in subsections (b)(1), (3), (4), and (5) shall be disclosed to any person except as limited by law.
- A nurse aide may request correction of inaccuracies from the department of health or department of human services and may request a contested case hearing under chapter 91 HRS if disagreement persists.

- Information in paragraph regarding substantiated findings shall remain permanently in the registry unless removed in accordance with §16-89A-6.
- Registry shall remove an entry for a nurse aide who has not performed nurse aide services for 24 consecutive months, unless the entry includes documented findings of abuse/neglect/misappropriation (those remain permanently unless removed under subsection (b)).24 months removal period
- A substantiated finding shall be removed by the applicable department if: the finding was erroneous, a court found the nurse aide not guilty, the State is notified of the nurse aide's death; or the nurse aide's history does not reflect a pattern of abuse/neglect/misappropriation and the original finding was a singular occurrence.

- An individual whose application for certification has been denied, or who disputes registry entries or reporting, shall be given notice and opportunity for a hearing pursuant to chapter 91, Hawaii Revised Statutes.
