Coverage Criteria for Vagus Nerve Stimulation

    Initial Implantation (Medical Necessity)

Covered when ALL of the following are met

Core Eligibility: Member is 4 years of age or older (FDA approved for ≥4 years); has not had a bilateral or left cervical vagotomy; has medically refractory partial onset seizures and at least one of the following:
Seizure refractoriness: Medically refractory seizures that occur despite therapeutic levels of anti-epileptic medications.
Medication intolerance: Seizures that cannot be treated with therapeutic levels of anti-epileptic drugs because of intolerable side effects.
Surgical considerations: Unsuccessful surgical intervention (lesionectomy or medial temporal lobectomy) OR patient was not a surgical candidate OR patient refused surgical intervention; if surgical intervention was attempted, seizures remain refractory to surgery.

    Replacement/Revision

Covered when ALL of the following are met

Replacement/Revision Coverage: Replacement or revision of a vagus nerve therapy system or handheld magnet is covered when the original system/magnet met medically necessary criteria, is no longer under warranty, and cannot be repaired.

    Device Analysis

    Covered when criteria are met

Device Analysis: Electronic analysis of an implanted neurostimulator pulse generator system for VNS is considered medically necessary when the coverage criteria for VNS are met and documentation supports the need for device interrogation/analysis.

EOCCO considers vagus nerve stimulation (VNS) to be experimental and investigational for the treatment of treatment‑resistant depression. The policy cites lack of well‑designed controlled clinical trials and notes that the single randomized controlled trial identified did not demonstrate statistically significant improvement in most measures of depression, so available evidence is insufficient to support effectiveness for this indication.

In addition, VNS is considered investigational and therefore not covered for a range of other non‑epilepsy conditions. Examples explicitly listed include, but are not limited to: addictions, Alzheimer’s disease (and cognitive impairment associated with Alzheimer’s), anxiety disorders, autism, headaches, obesity, obsessive‑compulsive disorder, Tourette’s syndrome, sleep disorders, heart failure, essential tremors, Crohn’s disease, pain syndromes, bulimia, cerebral palsy, coma, cancer, and generalized epilepsy syndromes.

Requests for VNS to treat any of the investigational indications listed above (including treatment‑resistant depression) are subject to denial because the effectiveness of VNS for these conditions has not been established in the evidence base described in the policy.

When submitting authorization requests, providers should document the specific diagnosis and supporting rationale; however, per policy language EOCCO will consider these non‑epilepsy uses investigational and not medically necessary regardless of submitted justification unless and until sufficient evidence demonstrates clinical benefit.

Prior Authorization, Documentation, and Provider Responsibilities

    Prior Authorization

Prior authorization required; affected CPT/HCPCS codes listed

Prior authorization is required. Submit neurologist medical records documenting the diagnosis of partial‑onset (focal) seizures and prior medical and surgical treatments tried and failed. The following CPT/HCPCS codes are subject to authorization for implantation, revision, removal, and device supplies: 61885, 61886, 64553, 64568, 64569, 64570, L8680, L8681, L8682, L8683, L8685, L8686, L8687, L8688.

    • Authorize for procedures and supplies only after required documentation is provided.
    • Codes listed correspond to insertion/replacement, implantation, revision, removal, and implantable device supplies.
    Step Therapy

    Medication trial requirement before VNS

Document trials of anti‑epileptic medications at therapeutic levels, or documentation that therapeutic levels could not be achieved because of intolerable side effects, prior to considering VNS.

    • Records must show medications tried, dosing/therapeutic levels, and reason for failure or intolerance.

    Background

A vagus nerve stimulator (VNS) is an implantable adjunctive therapy used primarily for medically refractory focal or partial‑onset epilepsy. The system consists of a pulse generator implanted subcutaneously (typically near the clavicle) that is connected to the left vagus nerve and delivers intermittent electrical stimulation intended to reduce seizure activity.

EOCCO’s policy treats VNS as durable medical equipment and allows coverage when specific medical necessity criteria are met, including minimum age and documentation of medically refractory seizures or intolerance to therapeutic anti‑epileptic medication.

    Documentation Required

Required clinical documentation from treating neurologist

Include medical records from the treating neurologist that document a diagnosis of partial‑onset seizures and comprehensive documentation of prior medical and surgical treatments tried and failed.

    • Clinical notes from the treating neurologist specifying seizure type and course.
    • Documentation of prior anti‑epileptic medication trials (drugs, doses, therapeutic levels, and outcomes).
    • If applicable, records of prior surgical interventions and their outcomes.
    Documentation Required

Eligibility documentation required (age, vagotomy status, refractory seizures)

Provide documentation demonstrating the member is age 4 years or older, has not had a bilateral or left cervical vagotomy, and has medically refractory partial‑onset seizures or intolerance to therapeutic medication levels.

    • Proof of age (medical record indicating DOB) showing ≥4 years.
    • Surgical history confirming absence of bilateral or left cervical vagotomy.
    • Evidence of medically refractory seizures (failure of therapeutic anti‑epileptic medication levels) or documented intolerance to therapeutic medication.
    Denial Risk

Denial risk for investigational (non‑epilepsy) indications

Requests for VNS to treat treatment‑resistant depression or other non‑epilepsy indications listed in the policy will be denied as investigational.

    • Examples of non‑covered investigational indications include treatment‑resistant depression, addictions, Alzheimer’s disease, OCD, Tourette’s syndrome, pain syndromes, and other listed conditions.
    • Submitters should provide documentation tying the request to the covered epilepsy criteria; requests for the investigational indications are not covered.
Seizures that cannot be treated with therapeutic levels of anti-epileptic drugs because of intolerable side effects
Context for eligibilityMember must have medically refractory partial onset seizures as part of core eligibility for VNS
