Observation claim post-inpatient denial — summary
DefinitionAn observation claim post-inpatient denial is a claim for observation level of care submitted after an inpatient level of care has been denied and all internal and external appeals have been exhausted.
PurposeAllows providers an opportunity to be considered for payment at a lower level of care (e.g., observation) rather than being denied for timely filing.
Timing requirementProvider may submit the observation claim within 60 calendar days of receipt of the final appeal denial letter, provided the initial inpatient timely filing period (180 days from date of service) has elapsed or there is less than 60 days from final denial.
Submission methodObservation claims submitted under this process must follow the special handling requirements (paper claim with required documentation) to avoid standard timely filing denial.
LimitationsThis policy does not change the provider’s responsibility for timely filing the initial inpatient claim; there is no further appeal or exception process related to this 60-day extension after that period elapses.
