OpenPayer is powered by Trek Health's payer performance platform. Trek continuously ingests, validates, and normalizes Transparency in Coverage data alongside payer policies and other commercial payer data to create a structured payer intelligence foundation. OpenPayer uses this foundation to deliver personalized search results, dynamically generated policy pages, and tailored policy monitoring based on each user's payers, specialties, billing codes, and areas of interest. The same intelligence powers broader payer performance workflows, including reimbursement benchmarking, contract evaluation, payer negotiations, and financial decision-making.

    Coverage criteria for bariatric surgery

    Initial eligibility criteria

Covered when ALL of the following are met

Primary eligibility: Patient has BMI >40 OR BMI >35 with one or more obesity-related comorbid conditions (e.g., degenerative joint disease, hypertension, hyperlipidemia, coronary artery disease, other atherosclerotic disease, Type II diabetes mellitus, sleep apnea, congestive heart failure).BMI >40 or BMI >35 w/ comorbidity
Age requirement: Patient is 18 to 60 years of age; requests for patients <18 must include documentation addressing impact on future growth, patient maturity, ability to understand the procedure and comply with post-operative instructions, and adequacy of family support; patients >60 may be considered with documentation that physiologic age and comorbidities result in a positive risk–benefit ratio.Age 18-60 preferred
Prior conservative therapy: Documented failure of non-surgical management including a structured, professionally supervised (physician or non-physician) weight loss program for a minimum of 12 consecutive months within the last 4 years, with documentation of periodic weights, dietary therapy, physical exercise, behavioral therapy/counseling and pharmacotherapy as indicated.12 months
Clinical evaluation by an M.D. or D.O. with documentation that the primary care physician and patient understand the risks and have reasonable expectations and that the patient will comply with post-surgical requirements.
Psychological assessment: Pre-surgical psychological evaluation by a contracted mental health professional to assess emotional stability, capacity for informed consent, and ability to cope with post-surgical lifestyle changes; may include up to one unit of psychological testing (e.g., MMPI-2 or MMPI-A).

    Revision surgery criteria

Revision surgery is covered when the following are met

Revision indications: For planned revision, documentation must include date and type of previous procedure, the factors precipitating failure, and any complications from the previous procedure that necessitate takedown. If the indication for revision is failure to lose a desired amount of weight, the patient must meet all initial preoperative criteria. Previous gastric restrictive procedures that failed for anatomic or technical reasons (e.g., obstruction, staple dehiscence) may be revised without consideration of the initial preoperative criteria.

Original Medicare specifies coverage conditions for bariatric surgery that must be met before services are payable. Covered beneficiaries must have a BMI over 35 and at least one obesity-related comorbid condition (for example, diabetes or hypertension), and must have been unsuccessful with other medical treatments for obesity. Covered procedures under these Original Medicare rules include open and laparoscopic roux-en-Y gastric bypass, open and laparoscopic biliopancreatic diversion with duodenal switch, and laparoscopic adjustable gastric banding when performed at approved, certified facilities. Facility certification requirements include American College of Surgeons level 1 bariatric surgery center status (standards in effect 2/15/2006) or American Society for Bariatric Surgery center-of-excellence designation. A CMS list of approved facilities is available on the CMS website.

Original Medicare explicitly excludes certain procedures from coverage and identifies additional procedures whose safety or long-term efficacy is not established. Not covered procedures include open adjustable gastric banding, open and laparoscopic sleeve gastrectomy, and open and laparoscopic vertical banded gastroplasty. The policy also states that the safety of intestinal bypass surgery and the long-term safety and efficacy of the gastric balloon have not been established and therefore these do not meet the Medicare reasonable and necessary standard. Additionally, stand-alone sleeve gastrectomy remains subject to local Medicare Administrative Contractor determinations and specific criteria where applicable.

    Provider responsibilities, documentation, and billing

    Prior Authorization

    Prior authorization & billing verification

Verify member benefits and cost-share prior to scheduling and follow Medicare Advantage PPO billing rules; submit required CPT/HCPCS and ICD-10 codes and supporting documentation to the local Blue Cross plan.

    • Verify benefits and member cost-share via the provider portal or by phone before performing services.
    • Use Medicare Advantage PPO unique billing requirements and report CPT/HCPCS and diagnosis codes to the highest level of specificity.
    • Submit claims (CMS 1500, UB-04 or 837) and required documentation to the local Blue Cross plan; include NPI on all claims.
    Step Therapy

    Prior conservative therapy requirement

Document that the patient was unsuccessful with medical (non-surgical) treatment for obesity, including participation in structured non-surgical programs, before considering bariatric surgery.

    Background and scope

Bariatric procedures encompass malabsorptive and restrictive surgical approaches intended to treat morbid obesity and related comorbidities. Malabsorptive operations divert food to reduce nutrient absorption, while restrictive procedures reduce stomach volume to limit intake. Original Medicare ties coverage to clinical criteria (BMI thresholds and comorbid conditions), prior unsuccessful non‑surgical management, and performance at certified facilities; procedures not meeting reasonable and necessary requirements or those expressly listed as not covered are excluded from payment.

    Key procedure definitions

inv-16: Malabsorptive — definition of malabsorptive procedures
DefinitionMalabsorptive procedure: surgery that diverts food from the stomach to a lower part of the digestive tract where normal mixing of digestive fluids and absorption of nutrients cannot occur.
Physiologic effectImpairs normal nutrient absorption by bypassing portions of the small intestine.
Clinical noteMay be combined with restrictive components in some bariatric operations.
inv-17: Restrictive — definition of restrictive procedures
DefinitionRestrictive procedure: surgery that restricts the size of the stomach to decrease oral intake.
Physiologic effectLimits the volume of food the stomach can hold, promoting earlier satiety and reduced caloric intake.

  1. Patient must have been previously unsuccessful with medical treatment for obesity.
  2. Include evidence of participation in structured, professionally supervised weight loss efforts (see documentation requirements).
  3. Documentation Required

    Required preoperative documentation

Include documentation of prior non-surgical management showing a professionally supervised weight loss program for a minimum of 12 consecutive months within the last 4 years, with periodic weights and therapies as indicated; include psychological evaluation and informed consent.

    • Minimum 12 consecutive months in a professionally supervised weight loss program within the last 4 years with periodic weights, dietary therapy, physical exercise, behavioral therapy/counseling and pharmacotherapy as indicated.
    • Psychological evaluation performed as a presurgical assessment by a contracted mental health professional (may include one unit of psychological testing).
    • Documentation that the M.D. or D.O. has evaluated the patient, discussed risks, and expects patient compliance with post-surgical requirements.
    Documentation Required

    Documentation for revision procedures

For planned revision procedures, document the date and type of the prior procedure, factors precipitating failure, any complications that necessitate takedown, and the indication for revision; if revision is for insufficient weight loss, the patient must meet all initial preoperative criteria unless failure was due to anatomic/technical reasons.

    • Date and type of previous procedure.
    • Factors that precipitated failure.
    • Any complications from the previous procedure that mandate takedown.
    • If revision indication is failure to lose desired weight, patient must meet initial preoperative criteria; exceptions allowed when prior restrictive procedures failed for anatomic or technical reasons.
    Denial Risk

    Medicare noncoverage triggers

Services that do not meet Original Medicare reasonable and necessary provisions or are specifically listed as not covered by Medicare may be denied and are considered noncovered.

    • Original Medicare does not cover open adjustable gastric banding, open and laparoscopic sleeve gastrectomy, or open and laparoscopic vertical banded gastroplasty.
    • Intestinal bypass surgery and gastric balloon are not established as reasonable and necessary and are not covered.
    • Stand-alone procedures without meeting documented criteria are considered not medically necessary and may be denied.
Clinical noteRestrictive procedures may be used alone or in combination with malabsorptive techniques.
