OpenPayer is powered by Trek Health's payer performance platform. Trek continuously ingests, validates, and normalizes Transparency in Coverage data alongside payer policies and other commercial payer data to create a structured payer intelligence foundation. OpenPayer uses this foundation to deliver personalized search results, dynamically generated policy pages, and tailored policy monitoring based on each user's payers, specialties, billing codes, and areas of interest. The same intelligence powers broader payer performance workflows, including reimbursement benchmarking, contract evaluation, payer negotiations, and financial decision-making.

    Adjudication & Documentation Criteria

    Adjudication and Documentation Criteria

    Applicability and adjudication process

Applies to hospital and professional claims.
Claims billed with modifiers XE/XS/XP/XU are automatically flagged by auditing software for prepayment clinical validation.
Prepayment review will seek supporting documentation and claim history demonstrating the distinct clinical circumstances described by the specific 'X' modifier applied (reviews mirror modifier -59 process and assess scenarios specific to each X modifier).
After clinical validation is completed prior to payment, claims are either reimbursed or denied for incorrect modifier use.

Distinct Procedural Modifiers and -59 Guidance

    Distinct procedural 'X' subset modifiersModifier
XESeparate Encounter — Service that is distinct because it occurred during a separate encounter.
XSSeparate Structure — Service that is distinct because it was performed on a separate organ/structure.
XPSeparate Practitioner — Service that is distinct because it was performed by a different practitioner.
XUUnusual Non-Overlapping Service — Service that is distinct because it does not overlap usual components of the main service.
    Concurrent use with modifier -59
Policy ruleIt is inappropriate to bill modifier -59 together with any 'X' subset modifier on the same claim.
ReasonCMS directed that 'X' subset modifiers be used instead of routine use of modifier -59 because the 'X' modifiers more precisely define distinct services.
Operational impactClaims containing -59 and any -XE/-XS/-XP/-XU on the same claim will be considered incorrect modifier use and may be denied after validation.

    Prepayment Validation & Documentation Requirements

    Documentation Required

Prepayment clinical validation and required supporting documentation

Claims billed with modifiers XE, XS, XP, or XU are automatically flagged by code auditing software for prepayment clinical validation. Clinical validation occurs prior to payment; after review the claim will be reimbursed or denied if the modifier is used incorrectly. Providers must have supporting documentation and relevant claim history available for the prepayment review, which will assess the distinct clinical circumstances represented by the specific X modifier applied (for example, whether more than one encounter per day supports XE, or whether different-specialty practitioners support XP).

    • Have supporting documentation and claim history available for prepayment review.
    • Documentation will be evaluated for the specific distinct circumstance claimed by the modifier (e.g., separate encounter for XE; separate practitioner and specialty for XP).

    Modifiers and Terminology

    Modifier -59
DefinitionModifier -59 — Distinct procedural service modifier; AMA revised its definition and created 'X' subset modifiers effective January 1, 2015.
CMS guidanceCMS indicates modifier -59 should not be reported routinely and should be replaced by a more accurate 'X' subset modifier when appropriate.
Usage noteUse -59 only when no more descriptive modifier applies; routine use is discouraged due to prior inappropriate use.
    XE / XS / XP / XU
XE — Separate EncounterService that is distinct because it occurred during a separate encounter.
XS — Separate StructureService that is distinct because it was performed on a separate organ/structure.
XP — Separate PractitionerService that is distinct because it was performed by a different practitioner.
XU — Unusual Non-Overlapping ServiceService that is distinct because it does not overlap usual components of the main service.
