Eligibility and discount rules for properties with FORTIFIED designation:
Permitted deviations
- Insurer may offer a discount or rate reduction greater than 30% if the discount or rate reduction is actuarially justified.
- To offer discounts or rate reductions below the 20% mandatory range, the insurer must file a request with the Commissioner including detailed actuarial justification seeking permission to deviate.

Insurer Filing & Approval Requirements
Discount filing approval — Commissioner approval required
All insurers authorized to write property and casualty insurance in Louisiana must obtain approval from the Commissioner for all premium discounts offered in accordance with this Regulation.
Request to offer lower discounts — file deviation with actuarial justification
If an insurer wishes to offer premium discounts or rate reductions below the mandatory twenty to thirty percent range, the insurer must file a request with the Commissioner seeking permission to deviate and include detailed actuarial justification for the proposed deficient premium discount or rate reduction.
Premium Discount Requirement — mandatory discounts for IBHS‑certified fortified properties
This rule establishes mandatory premium discounts or insurance rate reductions for homes and commercial properties certified as fortified pursuant to IBHS standards (Acts 1 and 12 of 2023 and Act 533 of 2024).
- Mandatory discount range for eligible properties: 20% to 30% (see §20909 and related criteria).
- Insurers may offer discounts greater than 30% if actuarially justified; deviations below 20% require Commissioner approval with detailed actuarial justification.
- Applies to properties certified as fortified under IBHS standards enacted by Acts referenced above.
