Coverage Criteria

General coverage requirements

Covered when services meet the statutory definitions and the member's Evidence of Coverage/Schedule of Benefits (EOC/SOB) terms, and are medically necessary.

Statutory parity and scope: Services for mental health and substance use disorders must be covered under the same terms and conditions as other medical benefits (parity of financial requirements and treatment limitations) and include a full range of levels of care, including basic and intermediate services such as residential treatment, partial hospitalization, and intensive outpatient treatment.

Patient financial responsibility parity: Patient financial responsibilities (for applicable plans) such as maximum annual/lifetime benefits, copayments, coinsurance, deductibles, and out-of-pocket maximums shall be applied equally to mental health and substance use disorder benefits as to other medical benefits.

Geographic and timely access: If medically necessary services are not available in-network within geographic and timely access standards, the plan shall arrange coverage for out-of-network services and ensure the enrollee pays no more cost sharing than for in-network services.

Consistency with member plan documents: Coverage is subject to the specific provisions, limitations, and exclusions stated in the member's EOC/SOB and the behavioral health Supplement; where discrepancies exist, the member's EOC/SOB governs.

Autism behavioral health treatment

Behavioral health treatment for pervasive developmental disorder or autism is covered when ALL of the following statutory conditions are met

Autism behavioral health treatment criteria: (1) Treatment is prescribed by a physician licensed pursuant to Chapter 5 or developed by a psychologist licensed pursuant to Chapter 6.6 of the Business and Professions Code; (2) Treatment is provided under a treatment plan prescribed by a qualified autism service provider and administered by a qualified autism service provider, qualified autism service professional supervised by the provider, or a qualified autism service paraprofessional supervised and employed by the provider; (3) The treatment plan includes measurable goals over a specific timeline, is reviewed no less than once every six months by the qualified autism service provider and modified when appropriate, and describes behavioral health impairments, the intervention plan (service type, number of hours, parent participation, frequency of progress evaluation), and uses evidence-based practices with demonstrated clinical efficacy; (4) Intensive behavioral intervention services are discontinued when goals are achieved or no longer appropriate; (5) The treatment plan is not used to provide or reimburse respite, day care, or educational services and is not used to reimburse a parent for participating in the treatment program, and the treatment plan shall be made available to the plan upon request.

General coverage determination

Covered when ALL of the following are met

Plan and medical necessity requirements: The service is listed in the member's EOC/SOB or is required by Federal/State Mandated Regulations and the service is medically necessary; providers must refer to the EOC/SOB and behavioral health Supplement for coverage eligibility, limitations, and exclusions.

The plan shall not limit or deny benefits for medically necessary services on the basis that those services "should be or could be covered by a public entitlement program," including but not limited to special education, Medicaid, Medicare, Supplemental Security Income, or Social Security Disability Insurance. The plan also shall not include or enforce contract terms that exclude otherwise covered benefits on that basis.

Specific coverage exclusions are defined in the member's Evidence of Coverage (EOC)/Schedule of Benefits (SOB) and the behavioral health Supplement to the EOC. Providers and administrators must refer to those plan documents for the exact exclusion language that applies to an individual member's benefits.

A behavioral health treatment plan for pervasive developmental disorder or autism must not be used for the purpose of providing or reimbursing respite, day care, or educational services, nor may it be used to reimburse a parent for participating in the treatment program. Treatment plans are clinical documents required to support therapeutic services and are not an allowable mechanism for these excluded uses.

Services that do not meet the plan's definition of medically necessary are not covered. Coverage for any service also depends on the member's EOC/SOB and applicable Federal/State Mandated Regulations; if a service is not medically necessary or conflicts with the member's EOC/SOB, coverage may be denied.
