Coverage mandate for behavioral health treatment for autism

Covered when statutory requirements are met as specified in California HSC §1374.73

Statutory coverage conditions: (1) Health plans providing hospital, medical, or surgical coverage must provide coverage for behavioral health treatment for pervasive developmental disorder or autism; (2) Coverage must be provided in the same manner and subject to the same requirements as Section 1374.72; (3) Insurers shall not require a rediagnosis to maintain coverage for previously diagnosed enrollees (effective Jan 1, 2026) and must not discontinue or delay existing treatment while awaiting a rediagnosis.

Behavioral Health Treatment for Autism Spectrum Disorder

Covered professional services and treatment programs for autism spectrum disorder when all criteria below are met:

Prescriber or developer: The treatment is prescribed by a licensed physician and surgeon or developed by a licensed psychologist as authorized under California law.

Prescription/development requirement per statute.

Provider qualifications and supervision: Treatment is provided under a treatment plan prescribed by a network qualified autism service provider and is administered by a network qualified autism service provider, a qualified autism service professional supervised and employed by the provider, or a qualified autism service paraprofessional supervised at clinically appropriate levels.

Provider definitions and supervision levels specified by statute.

Treatment plan elements: The treatment plan must include measurable goals over a specific timeline developed and approved by the qualified autism service provider, describe impairments, design an intervention plan specifying service type, number of hours, and parent participation, set frequency for progress evaluation and reporting, utilize evidence-based practices, be reviewed at least every six months and modified when appropriate, and discontinue intensive behavioral intervention when goals achieved or no longer appropriate.

This coverage requirement does not apply to a specialized health care service plan that does not deliver mental health or behavioral health services to enrollees, and it is not applicable to health care service plan contracts in the Medi‑Cal program. These exceptions follow California statutory language and must be considered when determining whether this policy section applies to a given plan.

The statutory provisions exclude certain types of insurance products from these requirements: specialized health insurance policies that do not cover mental/behavioral health, and policies such as accident‑only, specified disease, hospital indemnity, or Medicare supplement policies. In addition, contracts under the Medi‑Cal program are excluded. Confirm product type against these exclusions before applying the coverage rules in this policy.

A treatment plan used to support behavioral health services must not be used to provide or reimburse respite, day care, daycare, or educational services, and the plan must not be used to reimburse a parent for participating in the treatment program. Treatment plans are required to include measurable goals, service type and number of hours, parent participation, and be made available to the plan on request; plans must be reviewed at least every six months and updated when appropriate.

Certain items are explicitly excluded from behavioral health coverage: tuition for school‑based services provided under the Individuals with Disabilities Education Act (IDEA) is not covered. Also, prescription drugs are not covered under this behavioral health benefit unless the member has a supplemental prescription drug benefit that applies.

Medically necessary behavioral health treatment for autism will not be denied or unreasonably delayed on certain grounds: for example, due to an asserted need for cognitive or IQ testing; because the treatment is characterized as experimental, investigational, or educational; or because the provider is certified (rather than licensed) when that certification is from a recognized national entity such as the Behavior Analyst Certification Board accredited by the National Commission for Certifying Agencies.

Prior authorization and utilization review are permitted for autism behavioral health treatment when consistent with applicable California law. Utilization review (including prior authorization) is distinct from a provider-initiated rediagnosis and may be used to review, approve, modify, or deny treatment recommendations based on medical necessity. Plans may also use case management, network provider requirements, copayments, or other cost sharing, provided these practices comply with the referenced statutory requirements.

Utilization review may be prospective, concurrent, or retrospective.
