Refer to New Jersey Administrative Code Title 10 Chapter 52 Subchapter 1.8 for the full list of non-covered inpatient and outpatient services. Effective 12/01/2025, this policy explicitly lists the following conditions as exclusions from observation-level coverage in New Jersey: pneumonia; poisoning/toxic ingestions; renal colic/kidney stone; seizures; syncope and collapse; transient ischemic attack (TIA); urinary tract infection; vaginal bleeding (non-obstetrical); and weakness.

Observation services are not medically necessary when provided for the convenience of the hospital, physicians, members, or members' families, or when the member is receiving observation while awaiting placement to another health care facility.
