By contrast, maintenance therapy is supportive care intended to prevent deterioration or maintain function when further clinical improvement cannot reasonably be expected and is addressed per New Mexico regulations (NMAC 8.325.8: Specialty Services, Rehabilitation Service Providers). The policy relies on InterQual® outpatient rehabilitation criteria for clinical coverage determinations and uses New Mexico regulatory guidance for distinguishing maintenance therapy.

Initial Therapy Evaluation / Initial Therapy Visit Requests

Covered when ALL of the following are on file and included in the evaluation report:

Re-Evaluations

Compliance to home program
Description of current deficits and severity documented using objective data
Objective demonstration of progress toward each treatment goal using consistent/comparable methods
Updated statement of prescribed treatment modalities and recommended frequency/duration
Brief prognosis with clearly established discharge criteria
Updated individualized POC with measurable, functional, time-based goals not older than 90 days
If majority of goals not achieved, POC must include barriers or explanation for modification/discontinuation
A revised POC that lacks a meaningful update to support continued services will not be accepted; percentage accuracy alone is insufficient

Treatment Session Notes

All treatment session notes must include ALL of the following:

Group Therapy Documentation

Group therapy documentation must include ALL of the following:

Feeding and Swallowing Evaluations

For feeding and swallowing evaluations submit ALL of the following; assessment must result in one or more specified outcomes:

Collaboration with providers and caregivers; therapists determine candidacy based on medical stability, cognitive status, nutritional status, psychosocial/environmental/behavioral factors
Assessment must result in one or more outcomes: Description of characteristics of swallowing function including breakdowns in physiology; Diagnosis of a swallowing disorder; Determination of safest and most efficient route (oral vs non-oral) of nutrition/hydration; Identification of effectiveness of intervention and support; Recommendations for intervention/support for oral, pharyngeal, and/or laryngeal disorders; Prognosis for improvement and identification of other relevant factors

Discharge Criteria

Discharge is appropriate when ANY of the following, as applicable, occur:

Treatment goals and objectives have been met
Functional abilities comparable to individuals of same chronological age
Desired level of function agreed to by individual and provider achieved
Skill of a therapist or licensed professional is no longer required
Individual exhibits behavior interfering with improvement or participation and efforts to address have failed
Situations where discharge is appropriate if informed: Individual/family/guardian choose not to participate, relocate, or seek another provider after being advised of likely outcomes; Request to be discharged or to continue services with another provider; Individual transferred/discharged to another location where ongoing service is not reasonably available (efforts to ensure continuation should be made); Individual unable to tolerate treatment due to serious medical/psychological/other condition

The initial authorization must include a Plan of Care (POC) developed from the evaluation that documents the functional or physical impairment; specific short- and long-term therapeutic goals that are functional, measurable, attainable, time-based, and related to the diagnosed condition; and the treatment frequency, duration, and anticipated length of treatment sessions.

For continuation requests include, in addition to initial documentation: weeks of therapy previously authorized or visits attended; any additional therapies requested with frequency, duration, and anticipated session length; the member's current status compared to evaluation baseline and prior progress reports with objective, functional measures; comparisons of physical/functional status using the same assessments; objective measurements showing continued impairment versus normal or premorbid function; and evidence of ongoing need for skilled services.

Treatment notes must document the specific treatments provided that match the CPT code(s) billed, accurately record session length, describe the individual's response and skilled reassessment, and include the treating provider's signature and date to support claims.

Insufficient POC revision risk

A revised POC that does not include a meaningful update to support the need for continued services will not be accepted and may result in denial of continued therapy services; simply reporting percentage progress toward goals is not sufficient.

Speech/language testing for limited English proficiency

For individuals with limited English proficiency provide culturally and linguistically adapted norm‑referenced standardized testing in all languages the child is exposed to; ensure all speech and language deficits are present in the language of the individual's highest proficiency; and deliver therapy in the language of the individual's highest receptive language proficiency. For individuals with dyslexia include test results substantiating receptive or expressive language delay and goals addressing those deficits.
