Dynamic stabilization / facet arthroplasty / isolated facet fusion coverage considerations

Evidence-based stance and criteria groups regarding dynamic stabilization, facet arthroplasty, isolated facet fusion, and total facet arthroplasty:

Dynamic stabilization systems: Current evidence is insufficient to permit conclusions that dynamic stabilization provides a significant advantage over conventional fusion; most published studies are retrospective or case series lacking controls, and comparative complication and reoperation rates are unknown.

Facet arthroplasty (Nassr et al. 2024): A multicenter RCT of 321 patients (2:1 randomization to facet arthroplasty versus fusion) reported higher composite clinical success for decompression plus facet arthroplasty versus decompression plus fusion at 24 months, with superior PROMs and lower symptomatic adjacent-segment degeneration; limitations include short follow-up, industry funding, lack of blinding, and analysis including ~50% of randomized sample at the reported timepoint.24 months follow-up reported

Evidence requirement: Facet arthroplasty lacks well-designed, long-term randomized controlled trial data sufficient to conclude benefits and safety; preliminary RCT and interim reports exist but are inadequate to establish definitive coverage.

Interim and preliminary trial reports (including Nassr et al. RCT and earlier pivotal/interim reports) are noted but not definitive.

Dynamic Stabilization (TOPS System)

TOPS System PMA: The TOPS System received FDA premarket approval (PMA) on June 15, 2023; regulatory approval is informational and does not, by itself, establish coverage—clinical evidence and policy criteria determine medical necessity.

The policy classifies several posterior motion-preserving and limited-fusion approaches as unproven and not medically necessary when evidence is insufficient to demonstrate efficacy or safety compared with standard treatments. Specifically, the following are listed as unproven/not medically necessary: Isolated facet fusion (with or without instrumentation), dynamic stabilization systems for degenerative spondylolisthesis, and total facet joint arthroplasty. The rationale reflects limited published data (mostly retrospective series or small uncontrolled studies), short follow-up, and lack of randomized, long-term comparative trials to establish benefit over conventional fusion or decompression procedures. Additionally, the policy treats procedural organization of care as a coverage consideration: dividing multi-site decompression into multiple serial or staged operative sessions is not supported when a single session can address all sites due to insufficient evidence of efficacy.

Supporting evidence statements emphasize that there are no high-quality, long-term randomized trials demonstrating that facet fusion performed alone provides outcomes equivalent to standard spinal fusion; the literature is limited to small, uncontrolled studies with short follow-up and methodological limitations. For total facet arthroplasty, available data are preliminary or interim (including pivotal trial reports) but do not provide definitive long-term safety or durability evidence. For dynamic stabilization systems, the majority of studies are retrospective or case series and complication and reoperation rates relative to fusion remain uncertain.

Regulatory status affects but does not alone determine coverage. The policy notes that no facet arthroplasty devices have FDA approval at this time, which is a factor in the investigational stance for those devices. Conversely, certain dynamic stabilization devices (for example, the TOPS System) have received FDA review or approval in other contexts, but regulatory clearance is described as informational and not by itself a basis for coverage without supporting clinical evidence.

Isolated facet fusion, with or without instrumentation, is considered unproven and not medically necessary. This determination is based on limited evidence—small, uncontrolled trials with short-term follow-up and lacking randomized comparisons—and absence of studies evaluating facet fusion performed alone without concomitant decompression. Because current data do not establish that isolated facet fusion yields outcomes comparable to standard spinal fusion, the procedure is not supported for coverage.

The policy does not support routine division of a decompression into multiple, serial, or staged operative sessions when a single surgical session can adequately address all symptomatic sites. There is insufficient evidence to show that staged decompression provides additional benefit, and splitting treatment into multiple sessions may be considered not medically necessary if one session could resolve the pathology.

Further, the lack of evidence for staged or serial decompression is reiterated: published data do not demonstrate improved outcomes from performing decompression in multiple separate procedures when a single-session approach would suffice. Given this evidence gap, the policy cautions that staged decompression strategies are unsupported and may lead to denials if one-session treatment would have addressed all sites.

Prior Authorization and Medical Necessity

Prior authorization is required for spinal procedures and device-based interventions. Medical necessity will be determined using InterQual® CP procedures (Decompression ± Fusion; Fusion; Scoliosis/Kyphosis surgery, as applicable). Requests for services listed as unproven or subject to coverage/quantity limits will be evaluated per Ohio Administrative Code 5160-101.

Prior authorization required prior to scheduling when device implantation or fusion/decompression procedures are planned.
InterQual® CP will be used to determine medical necessity for the relevant procedure category.

Documentation Required

Verify Device FDA Status Before Authorization

Before submitting an authorization request for a device-based procedure, verify and document the device's regulatory status with the FDA. Provide device name and supporting FDA documentation (e.g., PMA, IDE/IDE trial identifier, 510(k), or PMN search results) when available.

Background and Context

Spinal fusion (arthrodesis) and decompression are operative techniques used to treat axial back pain, radicular symptoms, and neurologic compression. Arthrodesis (fusion) involves preparing the disc space or posterior elements and placing bone grafts (autograft or alternatives) with or without internal fixation (screws, rods, plates) to achieve bony union between vertebrae and reduce motion at a painful segment. Decompression procedures (laminotomy, laminectomy, foraminotomy, discectomy, or corpectomy) remove bone, ligament, or disc material that is compressing neural elements to relieve radicular pain and neurologic deficit. Patient selection for these surgeries relies on clinical impairment (for example, validated disability scores) and objective neurologic and imaging findings consistent with the symptomatic level.
