Conditions that must be met for a nonparticipating provider to bill a nonemergency patient for costs not covered by the patient's health benefit plan:
ALL of the following
- The nonemergency patient provides written consent at least 24 hours in advance to receive services from the nonparticipating provider.
- Consent may not be obtained at the time of admission or at any time when the nonemergency patient is being prepared for surgery or any other procedure.
- At the time consent is provided, the nonparticipating provider gives the nonemergency patient a written estimate of the cost of care for services to be provided.
- The consent must advise the nonemergency patient that they may elect to seek care from a participating provider or contact their health benefit plan to arrange for services from a participating provider at lower cost.
