ENGROSSED SUBSTITUTE HOUSE BILL 2642
State of Washington legislation (Engrossed Substitute House Bill 2642) establishing requirements for health plans, employer plans, managed care organizations and Medicaid MCOs effective Jan 1, 2021 to limit prior authorization and utilization management for withdrawal management and inpatient/residential substance use disorder (SUD) treatment in licensed behavioral health agencies, require notification and timelines, require payment during transfer arrangements, and direct development of a standard medical necessity criteria and action plan.
Prohibition on requiring prior authorization for withdrawal management and inpatient/residential SUD treatment in licensed behavioral health agencies for plans issued or renewed on/after Jan 1, 2021.
Notification and documentation timeframes for behavioral health agencies (notify within 24 hours; submit assessment/treatment plan within 2 business days or 3 days for withdrawal management).
Requirement that plans/MCOs pay current facility until seamless transfer is complete and prohibition on balance billing.
Mandate for Health Care Authority to develop an action plan and adopt a single standard set of medical necessity criteria and levels of care by Jan 1, 2021.
