Covered when the following nested criteria are satisfied:

ALL of the following

One initial hospital inpatient or observation E/M code (99221-99223) billed per physician or QHP per calendar date; the code level must incorporate all E/M services provided on the date of admission including those performed in other sites (e.g., office, ED, nursing facility).
Exceptions allowing additional initial codes for same patient/date
- Physicians or QHPs from different group practices may each bill an initial care code for the same patient on the same date.
- Physicians or QHPs from the same group practice with different primary specialties may each bill an initial care code for the same patient on the same date (Optum may identify specialties by related taxonomy codes for QHPs).
Principal Physician of Record should append modifier 'AI' to the initial care code to identify oversight of the patient’s care.
Patient need not be physically located in a designated observation area; 'observation status' refers to initiation of Observation Care rather than a specific facility area.

ALL of the following

One subsequent hospital inpatient or observation E/M code (99231-99233) billed per physician or QHP per calendar date; the code reported should reflect all services provided by that physician/QHP on that date.
Exceptions allowing additional subsequent codes for same patient/date
- Physicians or QHPs from different group practices may each bill a subsequent care code for the same patient on the same date.
- Physicians or QHPs from the same group practice with different primary specialties may each bill a subsequent care code for the same patient on the same date (Optum may identify specialties by related taxonomy codes for QHPs).

ALL of the following

Patient must have received a minimum of 8 hours and less than or equal to 24 hours of hospital inpatient or observation care on the same calendar date to report 99234-99236.
Admission and discharge services must be performed by the same provider, and that provider must be the Principal Physician of Record.
Medical record must include admission and discharge notes by the Principal Physician of Record and documentation that the Principal Physician of Record was present and personally performed the services.

ALL of the following

Discharge day management codes (99238-99239) document the total time the Physician or QHP spends on discharge activities, including final exam, discussion of the stay, instructions for continuing care, and preparation of discharge records, prescriptions and referrals.
Per CMS guidance, these codes represent a face-to-face E/M between the Principal Physician of Record and the patient; report for the date of the actual visit even if discharge occurs on a different calendar date.
Only one discharge day management service (99238 or 99239) is payable per patient per hospital stay.
Other physicians/QHPs who are not the Principal Physician of Record should use 99231-99233 for their final visit if they managed other health issues during the stay.

Providers must follow these billing and documentation rules for Hospital Inpatient and Observation E/M services to avoid denials and ensure correct reimbursement.

Single code per provider per calendar date for initial (99221-99223) and subsequent (99231-99233) hospital/observation E/M.
Append modifier AI to the initial care code when billed by the Principal Physician of Record to identify the overseeing physician/QHP.
When billing admission+discharge same date (99234-99236), the same Principal Physician of Record must perform both services and document an 8–24 hour stay and both notes.
Only one discharge day management service (99238/99239) is payable per hospital stay; other physicians/QHPs should report 99231-99233 for final visits if applicable.
Documentation must support the level of service and include times/duration, provider role (Principal Physician of Record when applicable), presence and performance of services, and that services provided at other sites on the date of admission are incorporated into the initial care level.
