- Claims must have an incurred date on or before December 31, 2011 to be considered; any Claim List containing one or more claims with an incurred date of January 1, 2012 or later will be rejected in its entirety.
- Claims must be paid before submission to ERRP; if a claim was incurred on or before December 31, 2011 but paid after that date, the sponsor may submit the claim only after it has been paid.
- Approval is subject to the actual availability of remaining appropriated ERRP funds and the rate of disbursement; CMS may change this stance and approve claims incurred after December 31, 2011 if funding circumstances change.
