Member Privacy & Access Rights

Privacy Notice Criteria

Stated practices and member options regarding access, amendment, restrictions, disclosures, and legal obligations.

ALL of the following

Access: Members may request and receive paper or electronic copies of their records; HealthPartners will provide records promptly and explain any limitations.
Amendment: Members may request corrections to inaccurate or incomplete information; HealthPartners may deny the request but will provide a written explanation in a timely manner and allow the member to submit a statement of disagreement to be included with the record.
Restriction Requests: Members may request restrictions on uses and disclosures of their information; HealthPartners will consider requests but may deny them if they would affect care or HealthPartners’ operations.
Accounting and Disclosures: Members may request a list of disclosures (an accounting) and whom information was given to; HealthPartners documents disclosures and provides lists when applicable.
Complaint: Members may file complaints with HealthPartners and with the U.S. Department of Health & Human Services Office for Civil Rights if they believe their privacy rights were violated; filing a complaint will not result in retaliation.
Authorization Required: HealthPartners will obtain written authorization before using or disclosing PHI for marketing, selling PHI, or most uses outside treatment, payment, and health care operations.
Legal Compliance: HealthPartners will use or disclose PHI as required by federal or state law.

If HealthPartners cannot provide requested records or a restriction cannot be accommodated, the member will be informed of the reason.
When an amendment request is denied, HealthPartners will notify the member in writing and permit the member to submit a written statement of disagreement to be included in the record.

Provider Responsibilities & Authorizations

Prior Authorization

Written Authorization Required

Written (paper or electronic) authorization from the member is required before HealthPartners uses or discloses protected health information (PHI) for marketing, the sale of PHI, or most purposes that are not treatment or payment. Examples include: sharing PHI with another organization so they can market their products or services to the member; providing PHI to an outside organization in exchange for payment when the information is sold; or any other use or disclosure outside treatment, payment, and certain public interest purposes unless another specific law or policy permits the disclosure without authorization.

Marketing and sale of PHI require prior written authorization.
Authorization must be obtained before the disclosure/use unless an exception applies under law.
Authorization may be revoked by the member in writing except to the extent action has already been taken in reliance on it.

Permitted Disclosures & Authorizations

HealthPartners may, without the member's written authorization, disclose PHI in a limited set of permitted circumstances required or allowed by law. Providers should document the legal basis for these disclosures in the medical record and follow applicable state and federal requirements when sharing PHI.
