Modifier 59 payment criteria

Modifier 59 will be accepted for payment only when documentation and claim information support distinct procedural service criteria and no more specific modifier applies. Claims undergo prepayment clinical validation and will be denied if modifier use is unsupported.

ALL of the following

Evidence of distinct procedural service (any of the following):
- Different session documented (separate encounter).
- Different procedure or surgery documented.
- Different site or organ system documented.
- Separate incision or excision documented.
- Separate lesion documented.
- Separate injury or distinct area of injury documented (including extensive injuries).
No more descriptive modifier applies — if an already established, more descriptive modifier is appropriate, that modifier must be used instead of Modifier 59.
Claim diagnoses and history support multiple body sites/areas treated when applicable (e.g., claim history or diagnosis codes indicate procedures on multiple sites).
Anatomical or other applicable modifiers are used to designate the areas of the body treated where required.
Claims billed with Modifier 59 are subject to prepayment clinical validation; after validation the claim will be released for payment or denied for incorrect modifier use.
Medical records should not be submitted for the initial (first‑time) prepayment review; medical records are required when submitting an appeal or reconsideration following a denial.

If modifier use is unsupported by claim data, the provider will receive a denial on the Explanation of Payment (EOP).
Providers may appeal denials and must submit full medical records per provider manual guidelines for reconsideration.

Prepayment clinical validation of Modifier 59 claims

All claims billed with Modifier 59 are subject to clinician-led prepayment clinical validation. A clinician reviews the billed claim details plus the member and provider claim history to determine whether Modifier 59 is supported; after validation the claim is either released for payment or denied for incorrect modifier use. If additional documentation is needed during validation, the plan may request supporting records as part of the review process.

Prepayment review applies to all claims billed with Modifier 59 and is performed by a clinician using CPT and CMS guidelines.
Outcome: claim is released for payment if supported, or denied if modifier use is unsupported.
Clinical review is based on the claim and member/provider claim history; documentation may be requested as part of validation.

Denial Risk

Submit full medical records for appeals/reconsiderations after denial

If the claim lacks sufficient documentation to support Modifier 59, the provider will receive a denial on the Explanation of Payment (EOP). The provider may submit an appeal/reconsideration per the provider manual and must include all pertinent medical records for the date of service and procedures billed; medical records are not required for the initial prepayment review but are required for reconsideration.

Denial notice will appear on the EOP when modifier use is unsupported.
To appeal, follow provider manual guidelines and submit all pertinent medical records for the billed date(s) of service.
Do not submit medical records for first-time claim review; only submit them when filing a reconsideration or appeal after denial.
