Services and supplies may be billed as "incident to" a physician's professional services when ALL of the following conditions are met:

ALL of the following

Service billed on CMS 1500 form by the physician or legal entity (charges must be included in the physician's/clinic's bill).
Applies to all Medicare Advantage products and CMS 1500 claims.
Supplies, drugs, and biologicals represent an expense to the physician or legal entity billing for the services (physician must have purchased the item); if the patient purchases the drug, the drug cost is not covered although administration may be payable.
Supervision
- Office/clinic setting: Direct personal supervision: physician must be physically present in the office suite and immediately available to assist and direct auxiliary personnel while services are performed.
- Homebound exception (when ALL below are met)
  - Patient is homebound (confined to home).
  - The service is an integral part of the physician's service to the patient and the physician retains overall supervision and professional responsibility; the physician orders the service(s) and maintains contact with the performing employee as needed.
  - Service is one of the individual or intermittent services allowed under the homebound exception (examples include injections; venipuncture; EKGs; therapeutic exercises; catheter insertion/sterile irrigation; catheter changes and specimen collection; dressing changes; nasogastric tube replacement/insertion; fecal impaction removal; sputum collection; paraffin bath therapy; teaching/training such as colostomy, tracheostomy care, diabetic foot care, blood pressure monitoring).
Auxiliary personnel (employees, leased employees, or independent contractors) furnishing the services are not excluded from Federal health care programs and act under the supervision of the physician.
There is a physician professional service that initiates the course of treatment of which the auxiliary personnel's service is an integral, incidental part, and the physician provides subsequent services with a frequency that reflects active participation in and management of the course of treatment (direct supervision requirement still applies to each non-physician service in the office setting).
For services performed in institutions (other than hospital or SNF outpatient contexts) or in patients' homes, direct supervision is required except where the homebound exception applies; hospital and SNF inpatient auxiliary services are not covered as incident to and are payable only under the hospital or SNF benefit.
Drugs dispensed directly to beneficiaries for administration 'incident to' a physician service may NOT be billed to UnitedHealthcare Medicare Advantage by pharmacies, suppliers, or providers (claims will be denied). When drugs are furnished to a physician for administration in the physician's office, pharmacies may not bill UnitedHealthcare Medicare Advantage under the 'incident to' provision unless the physician purchases the drug and bills for it as part of the physician's charges.

Charges for services and supplies furnished incident to the physician must be included in the physician's bill and reflect expense to the billing physician or legal entity; patient-purchased drugs are not covered as supplies but their administration may be payable if the physician would have purchased the drug.

You are responsible for submitting accurate claims on the CMS 1500 (or electronic equivalent). This policy ensures reimbursement is based on the code(s) that correctly describe services provided. UnitedHealthcare Medicare Advantage uses CPT, CMS, and other coding guidelines and may exercise reasonable discretion in applying this policy to particular cases.

Note

Homebound general supervision exception

The direct supervision requirement may be waived for certain services furnished to homebound patients in medically underserved areas when specific criteria are met. For these individual or intermittent services, personnel must meet any pertinent State requirements and the services must be an integral part of the physician’s service to the patient, performed under general physician supervision with ongoing contact and physician responsibility retained. All other incident-to requirements must be met and the services must be included in the physician/clinic bill.
