This reimbursement policy governs reporting and reimbursement of hospital inpatient and observation evaluation and management (E/M) services (initial, subsequent, admission/discharge same day, and discharge day management) for UnitedHealthcare Community Plan Medicaid product and applies to services billed on CMS-1500 or electronic equivalent.

Coverage criteria for hospital inpatient/observation E/M services

Reimbursement is allowed when documentation, clinician billing responsibility, and timing requirements are met. Only the Admitting/Supervising Physician or Other Qualified Health Care Professional (QHP) may report certain initial, same‑day admission/discharge, and discharge day management codes.

Initial Hospital Inpatient or Observation Care (CPT 99221-99223) reimbursable only when billed by the Admitting/Supervising Physician or Other QHP who ordered and was responsible for the patient during the observation stay.

When reporting Initial Hospital Inpatient or Observation Care (CPT 99221-99223), the medical record must document that the patient was designated or admitted to observation status and include dated and timed orders for the observation services.

When reporting Initial Hospital Inpatient or Observation Care (CPT 99221-99223), documentation must show that the Admitting/Supervising Physician or Other QHP explicitly assessed patient risk and determined the patient would benefit from observation care; this must be in addition to any ED or other site documentation.

When reporting Initial Hospital Inpatient or Observation Care (CPT 99221-99223), nursing and progress notes must be timed, written and signed by the Admitting/Supervising Physician or Other QHP during the observation period.

Same-date admission/discharge: For patients admitted to and discharged from observation on the same calendar date, report CPT 99234-99236 when the observation stay is at least 8 hours but less than 24 hours; the medical record must state the duration of the stay.

When reporting CPT 99234-99236, documentation must meet E/M requirements for history, examination and medical decision making, identify the Admitting/Supervising Physician or Other QHP as present and personally performing the services, and show that admission and discharge notes were written by that Admitting/Supervising Physician or Other QHP.

Hospital Inpatient or Observation Discharge Day Management (CPT 99238-99239) documents the total duration of face-to-face time on the date of the encounter spent by the Admitting/Supervising Physician or Other QHP for final discharge activities; only one discharge day management service is payable per patient per hospital stay.

Only the Admitting/Supervising Physician or Other QHP of record may report CPT 99238-99239; other physicians/QHPs who managed concurrent problems should report Subsequent Hospital Inpatient or Observation Care (CPT 99231-99233) for their final visit.

A Physician or Other QHP without inpatient admitting privileges but authorized to furnish hospital outpatient observation services may bill Initial Hospital Inpatient or Observation Care CPT codes when they ordered and were responsible for the observation care.

When Initial Hospital Inpatient or Observation Care is provided as part of other encounters on the same day (e.g., ED or office), the level of the initial hospital/observation CPT code should incorporate services provided in those other sites of service.

Initial Hospital Inpatient or Observation Care (CPT 99221-99223) must be billed only by the Admitting/Supervising Physician or Other Qualified Health Care Professional (QHP) who ordered the hospital outpatient observation services and was responsible for the patient during the observation stay. Medical records must document the patient’s designation to observation status and the clinician of record.

Only the Admitting/Supervising Physician or Other QHP who ordered and was responsible for the patient may report 99221-99223.
A Physician or Other QHP without inpatient admitting privileges may bill these codes if authorized to furnish hospital outpatient observation services.
