This includes relevant medical history, physical examination, results of pertinent diagnostic tests or procedures, the clinical rationale for testing, and any discussion with the patient about testing options and implications. Document when patient discussions lead to the decision to forgo confirmatory testing because the information gained would not affect clinical management.

Billing Rule

Specimen type limitation

Only urine or oral fluid specimens are covered for presumptive or definitive outpatient drug testing. Blood specimens are not covered except when medically necessary for patients with anuric chronic renal failure (CRF), in which case blood specimen collection is allowed and covered.

Confirmatory testing and interpretation

When confirmatory testing should be used per guidelines:

Use confirmatory testing when results will affect major clinical or nonclinical decisions (e.g., treatment changes, legal implications).

Confirm unexpected presumptive results on same sample using selective methods (GC-MS, LC-MS/MS).

Discuss unexpected results with patient prior to confirmatory testing when possible to obtain explanation.

Restrict confirmatory testing to situations where results will reasonably affect patient management to reduce costs.

Limitations of quantitative and immunoassay testing

Key validity concerns identified in studies and guidelines:

Quantitative urine levels often do not correlate reliably with dose due to pharmacokinetic and pharmacogenetic variability (studies report low R2 values).

Immunoassays have variable sensitivity and cross-reactivity; some EIAs show significant false negatives for opiates (~21% false negatives reported).

POC and lab-based immunoassays require knowledge of included drugs and limitations; consult package inserts and lab personnel.

Use of Urine Drug Testing (UDT) and Oral Fluid Testing - Guideline-based considerations

Policy summarizes consensus/recommendations from multiple organizations regarding indications/frequency/specimen types:

Colorado Division of Workers Compensation: requires mandatory UDT (per guideline summaries).

Regulatory and Laboratory Device Considerations

Regulatory statements that affect test performance and acceptance:

FDA: Laboratory-developed tests (LDTs) are regulated by CMS as high-complexity tests under CLIA '88; LDTs are not FDA-approved/cleared but FDA clearance is not required for clinical use.

HHS federal workplace drug testing: federal agencies must comply with guidelines (effective Oct 10, 2023) requiring each specimen be tested for marijuana and cocaine; HHS-certified labs may perform additional drug/specimen validity tests on case-by-case basis; defines adulterated specimen criteria and authorizes testing of oral fluid specimens per panel and biomarker testing as described in Section 3.4.

Billing Rule

No same-day duplicate testing

Same-day duplicate testing for the same drug or metabolites is not reimbursed. Examples include testing the same analyte from two different specimens collected the same day (e.g., blood and urine) or performing presumptive testing at point-of-care and also ordering the same presumptive test from a reference laboratory on the same specimen.

Billing Rule

No multiple presumptive tests per patient per date of service

More than one presumptive test result per patient per date of service is not reimbursed regardless of the number of billing providers. It is not reasonable or necessary to perform multiple presumptive immunoassay tests on the same specimen or to perform point-of-care presumptive testing and also order a presumptive test from a reference lab on the same date of service.

Billing Rule

Confirmatory testing rationale required

Confirmatory/definitive testing must be justified in the medical record. Document the specific rationale for ordering confirmatory testing (for example: presumptive result discordant with prescribed medications, unexpected positive for illicit substance, need to identify a specific drug within a large family, or a definitive concentration required to guide management). If the clinician determines confirmatory testing is not needed because results would not change management, document that discussion and rationale.

Denial Risk

Blanket or standing orders not reimbursed

Blanket orders or routine standing orders for drug testing for all patients in a physician's practice are not reimbursed. Orders must be individualized and supported by clinical documentation for each patient and each testing event.

Documentation Required

Baseline and ongoing monitoring by risk level

Baseline testing should be obtained prior to initiating opioid therapy and periodic monitoring should be performed thereafter based on the patient's assessed risk level: low risk — up to once yearly after initiation; moderate risk — up to twice yearly after initiation; high risk — up to four times yearly after initiation. For patients in substance use treatment, use the specified frequencies based on duration of abstinence. Document baseline results, ongoing test dates, risk assessment findings, and how results inform management. Use patient discussions to potentially avoid confirmatory tests when appropriate and document such decisions.

• LDT (Laboratory-Developed Test): an in-house test validated and regulated under CMS/CLIA as high-complexity testing; LDTs are not FDA-cleared/approved for clinical use.

• POC (Point-of-Collection): immunoassay tests performed at or near the site of patient care (dipsticks, cups, cards, cartridges) for presumptive screening; useful for rapid results but limited in sensitivity/specificity.

• Specimen adulteration / specimen validity/adulteration: alteration of a specimen evidenced by presence of substances not normal for that specimen or abnormal concentrations of normal constituents (e.g., nitrite in urine) indicating tampering.
