Medical Necessity and Coverage Criteria

Medical Necessity Definition

Covered when ALL of the following are met:

General medical necessity: Services or supplies that a physician exercising prudent clinical judgment would provide to an individual for the diagnosis and/or the direct care and treatment of the individual's medical condition, disease, illness, or injury; in accordance with accepted standards of good medical practice; clinically appropriate for the individual's medical condition, disease, illness, or injury; not primarily for the convenience of the individual and/or individual's family, physician, or other health care provider; and not costlier than alternative services or supplies at least as likely to produce equivalent results for the individual's condition, disease, illness, or injury.

'Generally accepted standards' include credible peer-reviewed evidence, specialty society recommendations, and relevant clinical opinion.

Medical Necessity — Out-of-Network Situations

Covered when ANY of the following are met:

Out-of-network medical necessity situations: 1) Ongoing course of treatment (beyond routine monitoring) for a serious and complex condition: either an acute illness requiring specialized treatment to avoid the reasonable possibility of death or permanent harm (e.g., chemotherapy, radiation therapy, or post-operative visits) OR a chronic life-threatening, degenerative, potentially disabling, or congenital condition requiring prolonged specialized care; 2) Urgent surgery, including postoperative care; 3) Pregnancy and related conditions; 4) Treatment for a terminal illness (as determined under section 1861(dd)(3)(A) of the Social Security Act); 5) Ongoing treatment where the treating provider attests that discontinuing care by that provider would worsen the condition or interfere with anticipated outcomes (provider attestation required); 6) No in-network providers with appropriate training and experience to provide the requested services (e.g., specialized surgery, specialty care for a rare condition); 7) Covered services not accessible/available from contracted providers who are closer than non-contracted providers or within reasonable distances; 8) Emergent services for which the closest provider/facility is out-of-network.

Non-covered health plan services remain non-covered when provided out-of-network. Prior Authorization Required for Non-Participating Providers

Requests for non-emergency care from non-participating practitioners or providers require prior authorization and medical review. Prior authorization is required for non-participating (out-of-network) providers for non-emergency care; non-covered health plan services remain not covered when provided out-of-network.

Providers should follow prior authorization and documentation requirements when requesting non-emergency out-of-network care. Requests must document the medical necessity for out-of-network care using the criteria below and include supporting clinical information to enable medical review.

Policy Background

This policy defines Capital Blue Cross' interpretation of medical necessity to guide coverage determinations when no more specific medical policy applies. Medical necessity is defined as services or supplies that a prudent physician would provide for diagnosis or direct care of the individual's condition; that are in accordance with accepted standards of good medical practice; clinically appropriate for the individual's condition; not primarily for convenience; and not costlier than alternative services likely to produce equivalent results. The policy also identifies the evidence sources used to establish those standards, including peer-reviewed literature, specialty society recommendations, and clinical opinion, and it specifies when out-of-network services may be considered medically necessary (for example, ongoing specialized treatment, urgent surgery, pregnancy-related care, terminal illness, or when no appropriate in-network provider is available).

Emergency service and network definitions

EMERGENCY SERVICE (definition)Any healthcare services provided after onset of a medical condition, including mental health or substance use disorder, that manifests with acute symptoms or severe pain such that a prudent layperson could reasonably expect lack of immediate medical attention to result in serious jeopardy, serious impairment of bodily functions, serious dysfunction of an organ or part, or other serious medical consequences; includes transportation, treatment, and related emergency services by a licensed emergency medical services agency when the condition meets this definition.

HOST BLUEA local Blue Cross and/or Blue Shield Licensee serving a geographic area other than our service area with contractual agreements with providers in that area that participate in the BlueCard program.

IN-NETWORK PROVIDERA professional or facility provider approved by Capital Blue Cross, licensed where required, providing covered services under a provider agreement and meeting credentialing and privileging criteria; provider status may change and members should verify current status.

OUT OF NETWORK PROVIDERA provider not under contract with Capital Blue Cross or not a BlueCard in-network provider.
