Medically necessary complication treatment

Covered when ALL of the following are met

Medical necessity for complications: Treatment of medical and surgical complications is considered medically necessary and covered when, without immediate intervention, the complication would lead to loss of life or limb.

Includes complications resulting from cosmetic or other non-covered procedures.

Outcomes that follow non-covered services — including cosmetic procedures, experimental or investigational surgery, procedures performed at inappropriate facilities, or surgery by unlicensed/uncredentialed providers — are not considered medical or surgical complications when the result is an unsatisfactory cosmetic outcome. Such outcomes are not covered under the subscriber agreement and therefore are not eligible for payment as complication treatment.

When a clinical problem after a non-covered procedure meets the definition of a medical or surgical complication (for example, an adverse event that, without intervention, would lead to loss of life or limb), treatment of that complication may be considered medically necessary and covered. Coverage remains subject to the terms, conditions, and limitations of the member's contract.

Treatments provided solely to correct an unsatisfactory cosmetic result from a non-covered procedure are not medically necessary and are not covered. Emotional or psychological benefit alone does not constitute physiologic function improvement and therefore does not make cosmetic revision medically necessary.

Providers and members should consult the subscriber agreement for benefit-specific exclusions; services that are part of a non-covered regimen of care remain excluded even if a procedure that would otherwise be covered occurs in that context.

Providers should complete an Advance Notice of Noncoverage (ANN) for commercial products prior to initiation, reduction, or termination of services that may be non-covered or not medically necessary. An ANN is required for physicians, laboratories, hospice providers, inpatient/outpatient hospitals, DME providers, skilled nursing facilities, and home health providers. An ANN should not be used when a service is covered but not separately reimbursed or is bundled in another service.

Initiation of services: beginning of new patient encounter, start of a plan of care, or beginning of treatment.
Reduction of services: decrease in frequency or duration of a component of care (e.g., PT reduced from five to three days/week).
Termination of services: discontinuation of items/services (e.g., discontinuing speech therapy deemed not reasonable/necessary).

Claims for services filed with GA, GU, or GX modifiers that indicate an ANN was expected will deny as member liability if an ANN has not been completed. Providers must ensure ANN documentation is completed and retained to avoid denial and member financial liability.

For Medicare Advantage products the ANN/ABN is not used. If a provider believes a service will not be covered, the provider must request a pre-service organization determination from the plan before rendering the service. If the provider does not request a pre-service determination and proceeds to render services, the provider will be liable for the cost of the services; Medicare Advantage members are held harmless.

If a pre-service organization determination is not requested for Medicare Advantage when coverage is uncertain, the provider may be liable for the cost of the services rendered. Medicare Advantage members will be held harmless; liability falls to the provider.

Background

A complication is an adverse event occurring in the course of another condition or during its treatment that may modify the course of the original condition and require revisions to the treatment plan. Complications may be medical or surgical in origin and can necessitate interventions to correct functional impairment.

Medical or surgical therapy for untoward events may also produce coincident cosmetic benefit (for example, treatment of severe burns). Coverage for complication treatment depends on clinical necessity — specifically, whether, without prompt intervention, the complication would lead to loss of life or limb — and remains subject to member contract terms.
