Modifier 22 coverage criteria

Modifier 22 may be considered for additional reimbursement only when substantial additional work is clearly documented and justified; certain uses are specifically inappropriate.

- Thorough documentation in the medical record must detail how the procedure was substantially greater than typically required and quantify the additional complexity.
  Operative report should specify how the procedure was more complex than usual and quantify how much more complex compared to the usual.
- Documentation must be part of the medical record; brief external letters or statements not included in the record are insufficient.

- Use of modifier 22 is the provider's representation that the service was substantially greater than usual.
- Appending modifier 22 does not guarantee additional reimbursement; the plan may request supporting documentation and claims are subject to review.

Acceptable justifications (one or more):

Increased intensity of the service.
Increased time required for the procedure.
Technical difficulty of the procedure.
Severity of the patient’s condition resulting in greater work.
Increased physical or mental effort required.

Examples of unacceptable justification (any of the following will not alone justify Modifier 22):

Generalized or conclusory statements (e.g., 'surgery took an additional two hours', 'this was a difficult procedure', 'surgery for an obese patient').

Field avoidance (anesthesia) — additional conditions for consideration:

Documentation of field avoidance must be included in the member’s anesthesia record.
Anesthesia base unit for the procedure must be less than 5 units.< 5 base units
Procedure performed around the head, neck, or shoulder girdle, and/or the position requires something other than supine.

Inappropriate uses (Modifier 22 should NOT be appended in these situations):

When additional work has a specific procedure code.
When procedures are prolonged or complicated by the surgeon’s choice of approach (e.g., difficulty gaining access).
When delays or impacts are due to equipment malfunction (e.g., lighting or malfunctioning scope).
If the procedure code does not have a global period of 0, 10, or 90 days.
E/M services, anesthesia services (except field avoidance as specified), DME services, or unlisted codes.

When requesting additional reimbursement using modifier 22, providers must submit contemporaneous, detailed documentation that supports the claim that the service was "substantially greater" than typically required. Appending modifier 22 is a provider attestation and does not guarantee payment; reimbursement is subject to review and approval.

Claims are subject to review and adjudication consistent with the member's plan documents, provider contract terms, coding edits, and applicable clinical and coding policies. Providers are responsible for accurate coding and submission of supporting documentation. Upon request, Blue Cross Blue Shield of New Mexico may require submission of additional records to substantiate billed services; failure to provide requested documentation may result in denial or recoupment.

Claims are reviewed against plan benefits, provider contract language, coding software logic, and clinical payment/coding policies.
Providers must submit accurate claims using valid code combinations and industry-standard coding guidelines (CPT, HCPCS, ICD-10, NDC, UB, etc.).
Be prepared to supply additional documentation upon request to support medical necessity, coding, or billed modifiers.
