Provider and Health Plan responsibilities
ALL of the following
- Comply with applicable state and federal law regarding advance directives and medical powers of attorney (including the Patient Self-Determination Act, Omnibus Budget Reconciliation Act of 1990, and Texas Health and Safety Code).
- Provide written information to all adult members regarding: (1) their right to accept or refuse treatment; (2) their right to formulate advance directives; and (3) the Health Plan's written policies on implementation of those rights.
- Document in each adult member's medical record whether or not the member has executed an advance directive.
- Treat all members equally in the provision of care regardless of whether or not the member has executed an advance directive.
