Documentation supports that the procedures/services were distinct by one or more of the following: different session, different procedure or surgery, different site or organ system, separate incision/excision, separate lesion, or separate injury (or area of injury in extensive injuries).
No more descriptive, established modifier is appropriate; Modifier 59 is only used if no more descriptive modifier is available and it best explains the circumstances.
Modifier 59 is not appended to Evaluation and Management (E/M) services.
ALL of the following
- Documentation components (any):
  - Diagnosis codes on the claim indicate multiple conditions or multiple sites were treated or likely to be treated.
  - Claim history/diagnostic testing indicates procedures were performed on multiple body sites or areas.
  - Applicable anatomical modifiers and all applicable diagnoses and services are coded to designate the areas of the body treated.

Prepayment clinical validation and appeals

Code auditing software flags all claims billed with Modifier 59 for prepayment clinical validation. Clinical validation occurs prior to claims payment and claims flagged with Modifier 59 may be denied if documentation is insufficient to support the modifier. If a claim is clinically validated it will be released for payment; if not, it will be denied for incorrect modifier use. Providers should be prepared to submit an appeal/reconsideration with all pertinent medical records for the date of service and procedures billed when a denial is received. Do not submit medical records with first-time claims — first-time claim review is limited to the claim and available member/provider history. Medical records should only be submitted when requesting reconsideration or appeal after a denial.
